PARTICIPANT RELEASE OF LIABILITY/WAIVER OF CLAIMS

IN CONSIDERATION OF Valkyrie Adventures Inc. (“Valkyrie Adventures”) permitting me to participate in tours, activities, and other related events organized and run by representatives of Valkyrie Adventures. Activities include, but are not limited to, guided hiking and backpacking trips and tours of various lengths, outdoor confidence-building experiences, and other lodge-based adventure experiences led by any representative of Valkyrie Adventures (hereinafter, the “Activities” and each individually an “Activity”). Representatives of Valkyrie Adventures (the “Guide(s)”) will lead and supervise each Activity.

I waive any claim I might have against Valkyrie Adventures for any harm that may occur at or as a result of my participation in an Activity.

IMPORTANT — THIS IS A WAIVER OF LEGAL RIGHTS

I AGREE THAT:

  • The Activities involve risk;

  • I accept those risks; and

  • I waive my right to commence legal action against Valkyrie Adventures or any representative thereof if I am injured while participating in an Activity.

I WARRANT THAT:

  • I understand the risk of serious personal injury, death and exposure to  communicable and/or contagious disease or illness which any participant in an Activity must assume. Risks may include, but are not limited to, overnight exposure, uneven or unstable ground, limited sanitation, wildlife encounters, and delayed access to emergency services in remote or backcountry environments.

  • I believe that I am physically and mentally able to participate in the Activity I have chosen.

  • I acknowledge that the consumption of alcohol or any substance that impairs judgment, coordination, or physical ability during the experience is strictly prohibited, and I understand that Guides or other representatives of Valkyrie Adventures may restrict or refuse participation if impairment is suspected.

  • I understand that all applicable rules for participation must be followed and that at all times the responsibility for my personal safety and well being remains solely my own. I agree to follow all guide instructions, safety protocols, and Activity-specific requirements, to communicate immediately regarding fatigue, injury, discomfort, or deterioration in my physical or mental condition, and to refrain from any action that may pose a hazard to myself or others. I understand that Activities may take place in remote or backcountry environments with limited services and delayed access to emergency response.

  • I will immediately remove myself from participation in an Activity, and will notify the Guide, if at any time I sense or observe any unusual hazard or unsafe condition, or if I feel that I have experienced any deterioration in my physical or mental fitness that necessitates removal from the Activity. I agree to stop and seek assistance if I do not believe I can safely continue and to limit my participation to reflect my personal fitness level. I will refrain from any and all actions that pose a hazard to myself or others.

I UNDERSTAND AND AGREE, on behalf of myself, my heirs, assigns, successors, personal representatives and next of kin, that my participation in any Activity and execution of this document constitutes:

  • An unqualified ASSUMPTION OF ALL RISKS associated with participation in this Activity by me, even if arising from negligence, including any compounding or aggravation of personal injuries caused by negligent rescue operations or procedures, of the Activity’s Guide and any persons associated therewith or participating therein, and 

  • A FULL AND FINAL RELEASE AND WAIVER OF LIABILITY of Valkyrie Adventures, its agents and/or employees, contractors, subcontractors, independent guides, third-party operators, partner organizations, other participants, and all persons and organizations associated with it and the Activity I participate in, including, without limiting the generality of the foregoing, its officers, directors, officials, agents and/or employees, other participants, sponsors, advertisers, owners and/or lessors of the premises used to conduct the Activity, sanctioning bodies, medical or rescue personnel (the “Releasees”), of and from with respect to all injury, illness, disability, death, loss or damage to person or property whether arising from negligence, or negligent rescue of or by the foregoing or otherwise, and

  • An UNDERSTANDING, DISCHARGE and COVENANT NOT TO SUE the Releasees for any loss of property, personal injury, illness, death, costs or damages of any form or type, however cause or arising, and whether directly or indirectly arising from the participation in this Activity by me and,

  • An AGREEMENT TO INDEMNIFY and to SAVE and HOLD HARMLESS the Releasees, and each of them, from any litigation expense, legal fees, liability, damage, award and cost, of any form or type whatsoever, they may incur due to any claim made against them or any one of them whether the claim is based on the negligence or the gross negligence of the Releasees or otherwise.

  • I authorize Valkyrie Adventures and its Guides to obtain or provide emergency medical care for me if injury or illness occurs during an Activity. I understand that medical services in remote areas may be delayed or limited. I agree that I am responsible for any costs associated with medical treatment, evacuation, rescue services, or transportation resulting from my participation in the Activity.

  • I understand that not all risks associated with the Activities can be foreseen or anticipated. I accept that additional or unknown risks, hazards, or dangers may arise during an Activity that are not specifically listed in this document.

  • I acknowledge that emergency evacuation or rescue in remote environments may be delayed, unavailable, or dependent on weather, terrain, or other factors beyond the control of Valkyrie Adventures

  • THIRD-PARTY OPERATED ACTIVITIES

    I understand that some Activities offered or included in an itinerary offered by Valkyrie Adventures may be operated by independent third-party providers. Valkyrie Adventures does not provide technical instruction for such Activities and does not control the operational decisions, supervision, equipment, or Activity-specific safety measures of those providers. Responsibility for instruction, equipment, supervision, and safety rests solely with the third-party operator. I understand that participation in third-party operated Activities is subject to the rules and safety decisions of that provider, and I acknowledge that I may be required to sign additional waivers with third-party operators.

  • This agreement shall be governed by and interpreted in accordance with the laws of the Province of Nova Scotia and the laws of Canada applicable therein.
